These Terms of Use apply to the RHS Chelsea Sustainable Garden Product of the Year award (the “Award”). 

1. Award Winner: There is only one Award Winner, being the named person or entity that is the exhibitor of the winning product.  The Award is given to an exhibitor for the particular product that was awarded the Award.  
2. Finalist: In these Terms each named person or entity that is the exhibitor of a product that is shortlisted as a finalist for the Award is referred to as a “Finalist”. A Finalist may not refer to itself as a winner or to its products as award-winning. 
3. The physical Award:  Each Award Winner and Finalist will receive a physical Award from the RHS.  
4. The Digital Asset: Where a Digital Asset of the Award is available, the RHS will provide an appropriate Digital Asset to the Award Winner and Finalists.  An Award Winner and Finalist may only use the Digital Asset provided to it by the RHS and must not create its own physical, photographic or digital image of the Award, or anything confusingly similar, or alter any Digital Asset provided by the RHS.   
5. The Award Statement for the Award Winner:  If an Award Winner wishes to refer to winning an Award, it must use the Award Statement, which specifies the year of the RHS Chelsea Flower Show in which the Award was awarded and the winning product.  For example:  RHS Chelsea Sustainable Garden Product of the Year Winner [2024] for our [self-watering plant pots].  
6. The Award Statement for a Finalist:  If a Finalist wishes to refer to being a Finalist, it must use the Award Statement, which specifies the year of the RHS Chelsea Flower Show in which they were a Finalist and the shortlisted product. For example:  RHS Chelsea Sustainable Garden Product of the Year Finalist [2024] for our [sustainable garden net]. 
7. Use of the Digital Asset and/or the Award Statement:  No one other than the Award Winner and Finalists is permitted to use the Digital Asset and the Award Statement.  Each Award Winner and Finalist may use the Digital Asset and/or the Award Statement in its own printed and digital marketing materials related to its business, and in retail displays relating to its business, provided that each use of the Award is in relation to the product that was award winning or shortlisted.  Examples of prohibited uses include use of the Digital Asset or Award Statement on products, product labels or packaging, vehicles, uniforms or signage (other than signage within a retail display). 
8. All other uses are prohibited:  Unless the RHS has given its prior written consent, all other uses of a Digital Asset or Award Statement are strictly prohibited.  An Award Winner and Finalist must not permit, allow or enable any third parties to use a Digital Asset, an Award Statement or anything confusingly similar to them. 
9. Duration:  An Award Winner and Finalist may use the Digital Asset and Award Statement for a period of three (3) years from the last date of the RHS Chelsea Flower Show in which its product was award winning or shortlisted.  After this period, an Award Winner and Finalist must immediately cease its use of the Digital Asset and Award Statement, as applicable. 
10. RHS Trade Marks:  Use of the RHS’ names, logos or trade marks other than as set out in these Terms of Use is strictly prohibited.  
11. Conduct:  An Award Winner and Finalist must not do anything that, in RHS’s reasonable opinion: (a) does not align with the RHS’s current aims, strategy or policies; or (b) may bring the RHS, the Award or the RHS Show into disrepute, or damage their reputation or goodwill.  
12. Termination of Use:  On written notice, the RHS may terminate the rights of an Award Winner and Finalist under these Terms of Use if the RHS reasonably considers that they have not complied with these Terms of Use, and on receipt of the notice they must immediately cease their use of the Digital Asset and Award Statement, as applicable. 
13. Amendment:  The RHS may amend these Terms of Use from time to time.  The RHS will make the current Terms of Use available in the online exhibitor portal each year and on the RHS website.  Please check to ensure you comply with the current Terms of Use.
